One killed in trucking company lot accident

One person is dead after a rather strange pedestrian accident in the lot of a trucking company in West Virginia. While police are still investigating the accident, they have said that at least at this point, no criminal activity is suspected.

The man who died was known to frequent the business premises of the company, but he did not work at the company. According to authorities, he was on the premises when a dump truck struck him, although authorities were not certain of the exact cause of the accident.

While the man has yet to be identified, there is little doubt that he has family somewhere who are going to miss his presence profoundly. Obviously, there will be final medical bills and funeral expenses, and if the man was breadwinner, a West Virginia family is also now without a source of income that they were counting on.

This tragic case raises some interesting legal questions. For one, is the driver of the dump truck that hit the man liable for the accident? This is a question that may need to be answered by an attorney, because whether this driver was negligent depends on the circumstances, since drivers are generally not expected to avoid pedestrians that they cannot either see or anticipate.

However, because the man also was on the private property of a trucking business, seemingly with permission, the business may be liable in a wrongful death action even if the dump truck driver involved was not working for the company or was not directly at fault.
