What is wrongful death?

Wrongful death law is the area of the law that protects family members of victims wrongfully killed in an accident. Wrongful death injuries are the worst type of harm that can be suffered by victims in a car accident or other type of accident. Surviving family members may be left with unexpected financial challenges as they struggle to deal with the emotional challenges they face following the unexpected loss of a loved one.

A wrongful death claim for damages can be brought for the benefit of surviving family members. Surviving family members of lost loved ones may be able to recover compensation for funeral and medical expenses, loss of support and services, lost prospect of inheritance and other damages depending on the circumstances. Damages that may be available are specific to the circumstances and the characteristics of the victims.

When determining damages in a wrongful death action for damages, the age of the lost loved one is considered along with the character and condition of the lost loved one, the earning capacity of the lost loved one, the life expectancy of the lost loved one, the health and intelligence of the lost loved one and the circumstances of the surviving loved ones for whom the wrongful death action was brought.

When a loved one has been wrongfully killed by the negligence of another party, a wrongful death claim serves as a resource to help surviving family members recover compensation for their damages and a safeguard to hold the negligent party accountable for the harm they have caused. Because of the dramatic changes to the lives of surviving family members following a fatal accident, it can be vital for them to be familiar with wrongful death legal options available to help them.
