What is a wrongful death action?

If you have had a loved one killed in a wrongful death accident, you may have heard of a wrongful death legal claim for damages but may not have understood exactly what is was or how it could help. In general, a wrongful death claim is a claim brought on behalf of the surviving family members of a loved one wrongfully killed because of someone else's negligence. Wrongful death clams are based on state statutes so it is important to know the laws in your state.

Surviving family members who have suffered the unexpected loss of a loved one may be able to pursue a wrongful death action which can help them recover damages for the financial and emotional injuries they have suffered. Damages are based on the circumstances and characteristics of the victim but can include damages for loss of support and services, lost prospect of inheritance, medical and funeral expenses and pain and suffering damages.

Wrongful death claims can be somewhat technical and complex so trained guidance throughout the process of bringing a claim can be helpful. Wrongful death claims are brought by a representative of the lost loved one's estate for the benefit of surviving family members such as a surviving spouse or children. A wrongful death claim is intended to help surviving family members with the uncertain future they face following the unexpected loss of a loved one.

The personal injury legal process provides assistance and resource to families of victims wrongfully taken from them. Because of the importance of the legal help provided, it is helpful for surviving family members and families to be familiar with the legal options available to help them.
