Wrongful death lawsuit filed in Kanawha County

Nursing homes and health care facilities are required to provide adequate long-term care to their residents. When facilities or their employees act negligently, the residents may experience new illnesses or a worsening of their original medical conditions. Negligence may include a failure to treat medical conditions, physical and mental abuse and neglect.

Some residents experience injuries and illnesses that eventually lead to their untimely death. In a case involving the Oak Ridge Center, Genesis HealthCare in Kanawha County, a breach of standard of care of treatment may have caused the death of a resident. The resident's daughter is now suing the facility for wrongful death and medical negligence.

The resident was admitted to the facility a few years ago and suffered a multitude of injuries and mistreatment while there. She suffered unwitnessed falls, acute renal failure, dehydration, medical malnourishment and wound infection. She passed away in December of 2014 after experiencing septic shock. The woman's daughter alleges that the facility is responsible for her death for failing to examine the woman in a timely fashion and failing to properly diagnose and treat the woman's medical condition.

While nothing will make up for the loss of life this woman's family has experienced, the damages recovered in a wrongful death lawsuit can help them move forward after their tragedy. The family could recover compensatory and punitive damages. If the family can prove that the facility was negligent in providing care to the woman and that their negligence caused her death, they can recover these damages.
