Woman brings slip and fall lawsuit against major retailer

Victims who are harmed by an unsafe property condition have legal options to consider. A woman has brought a premises liability claim in West Virginia against a major national retailer, asserting that she slipped and fell in one of its stores. The victim asserts that she was shopping in the store as a customer when she slipped and fell on a wet and slippery substance on the floor. As a result of falling on the liquid substance left on the floor, the woman further asserts in her lawsuit that she slipped and fell and injured her shoulder.

The woman suffered serious and permanent injuries to her left shoulder as a result of the slip and fall accident. The victim was diagnosed with a torn rotator cuff and torn tendons as a result of the injuries she suffered in the fall and had to undergo surgery as well as additional medical treatment. The woman asserts in her lawsuit that the national retailer was negligent in failing to maintain the property in a reasonably safe condition and for failing to remedy a dangerous property condition.

The lawsuit additionally asserts that the national retailer breached its duty of care to her as a customer by failing to inspect the property for unsafe property conditions. The victim is seeking damages for her injuries. In general, there is a reasonable expectation of safety when on the property of another. The laws can vary by state but property owners generally have a duty to keep their property free of unsafe property conditions or to warn of an unsafe property condition on the property.

When a victim has been harmed by an unremedied property condition they were not warned of that was known, or should have been known, to the property owner, the property owner may be liable to compensate them for their damages including medical expenses, lost wages and pain and suffering damages. A personal injury claim for damages based on a premises liability claim may help victims injured by a dangerous property condition recover compensation for their physical, financial and emotional damages which is why victims should always be familiar with the legal options available to them.
