Man alleges wrongful death against W.Va. nursing home

Excluding visitors and staff, most people only go to a nursing and rehabilitation center when they absolutely have to. For example, when elderly people are no longer able to care for themselves, a nursing facility would be a place where trained professionals could care for them. Likewise, if a person is suffering from some kind of long-term illness, or recovering from a traumatic injury, he or she might have to check into a nursing and rehabilitation center for some kind of extended treatment.

No matter the reason, when a person goes to a nursing home and rehabilitation center, he or she expects that doctors, nurses and all staff members will do their best to treat the patient. However, like people in any other profession, medical professionals and other staff members at these facilities do sometimes make mistakes while on the job. The difference is, that when someone who is treating a dependent person makes a mistake while rendering that care and treatment, it could mean the end of the patient's life.

Recently, a man filed a lawsuit against Genesis Healthcare in which he alleged that its staff, along with other defendants, caused his wife to die while she was a resident at Raleigh Center, which offers nursing and rehabilitation services. In the man's complaint, he claims that the staff members did not give his wife oxygen, which ultimately caused her to die from pneumonia and chronic obstructive pulmonary disease. The man filed his lawsuit in Kanawha Circuit Court and is asking for compensatory and punitive damages for his wife's pain and suffering, mental distress and other injuries.

No hospital, nursing home or other healthcare institution can save everyone's lives. But, when the staff members of the facility fail to properly carry out their duties, it can cause a patient his or her life. Family members who have lost a loved one due to negligence or medical malpractice may be able to pursue a wrongful death cause of action against the responsible parties.
